Franczek Partner Jackie Wernz Quoted in Education Dive Article on Title IX

On September 8, 2020, the national online publication Education Dive quoted Franczek P.C. Partner Jackie Gharapour Wernz in an article addressing Title IX of the Education Amendments of 1972. The Education Dive article addresses OCR’s recent publicized shift in perspective on Title IX’s application to sexual orientation and gender identity. In addition to addressing the legal impacts of OCR’s decisions, Wernz explained that OCR’s actions are yet another example of the agency’s swing away from Obama-era positions in the area of Title IX. Wernz explained that these swings have left schools with feelings of whiplash and that many school leaders worry that there will be shifts in the opposite direction depending on the outcome of the election in November. Wernz stated:  “Many are wondering, “Is any of this going to matter in January [with a potential change in president]?” Until we know for sure, below is what schools, colleges, and universities should know about the newest changes to OCR’s positions.
