 About the Talk

For decades, affirmative action reshaped higher education by opening pathways for underrepresented communities. But the Supreme Court’s 2023 decision in Students for Fair Admissions v. Harvard marked a turning point—one that both ends of the political spectrum have interpreted in sharply contrasting ways. Yale Law School Professor Justin Driver argues that both sides are wrong.

In his provocative and timely new book, The Fall of Affirmative Action, Driver critiques the post-SFFA admissions regime and offers universities a path forward that protects diversity, equity, and opportunity—without violating the Court’s ruling. He outlines how policies can still support students from marginalized backgrounds and challenges the notion that the death of affirmative action must mean the death of educational opportunity.

 About the Author

Justin Driver is the Robert R. Slaughter Professor of Law at Yale Law School and a leading constitutional scholar. A former editor of the Harvard Law Review and Supreme Court clerk, Driver’s work has been featured in The New York Times, The Washington Post, and on PBS NewsHour.
