Labor, Employment & Employee Benefits
Franczek’s unique combination of employment and education law provides our clients with unmatched experience representing and counseling educators with respect to the unique labor and employment challenges faced by educational institutions. From counseling clients on conducting effective teacher evaluations, to investigating misconduct, to drafting remediation plans, to representing school districts in teacher termination hearings, to drafting and negotiating administrator contracts, our combined experience, reputation, and resources in labor and employment law, truly sets us apart from other firms.
We counsel and defend schools and school districts on all matters related to the employer-employee relations. Our attorneys counsel and litigate on all federal and state employment laws, including the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), the Fair Labor Standards Act (FLSA), and the Victims’ Economic Security and Safety Act (VESSA).
Our attorneys have negotiated hundreds of bargaining agreements with teachers, support staff, custodians, and other unionized groups. We have worked in school districts of all sizes (from 400 students to 400,000 students). Our approach is always to seek practical solutions to problems in an environment that promotes collaboration and strengthens relationships whenever possible.
Our employee benefits attorneys have extensive experience in counseling clients with Teacher Retirement Service (TRS) regulations, as well as matters dealing with the Illinois Pension Code. We also provide a full range of employee benefits services, including the drafting and revisions of policies and plans that comply with the Public Health Service Act, HIPAA, the Internal Revenue Code, payroll tax requirements, COBRA, and Section 409A.
