ADA Update: What the EEOC’s Regulatory and Litigation Initiatives Mean for Employers

On September 23, 2009, the Equal Employment Opportunity Commission issued new proposed regulations to the Americans with Disabilities Act in order to comply with the ADA Amendments Act (ADAA). The ADAA and its implementing regulations will dramatically expand the number of employees entitled to protection under the ADA.

The EEOC has also served notice that it will aggressively challenge employers “inflexible” disability leave policies under the ADA. As previously reported, the Chicago District Office of the EEOC recently announced its largest settlement in ADA history against Sears Roebuck, and has recently filed other “pattern and practice” lawsuits against major nationwide and regional employers alleging that the employers’ leave policies failed to reasonably accommodate disabled workers.  (To see our previous eBulletin on this subject click here).

The expanded coverage of the ADA combined with the EEOC’s aggressive litigation posture promise to further complicate what is already a vexing issue for employers: how to effectively and legally deal with employees on long-term disability or illness-related absences.

 In response to overwhelming client interest and concern on this topic, on November 4, our attorneys will address these developments and offer practical steps that employers can take to meet their obligations under the ADA and avoid becoming a target of EEOC initiated litigation.  Attendees can receive CLE credit for this webinar.
