Judges Explains Tossing of CVS Severance Agreement Lawsuit

Jeff Nowak was quoted in an article in the article published by the Chicago Tribune , "Judges Explains Tossing of CVS Severance Agreement Lawsuit," discussing a federal lawsuit filed the by U.S. Equal Employment Opportunity Commission against CVS drugstore that challenged an employee severance agreement that contained common language used by employers. The article stated a federal judge dismissed the case on a technicality. Jeff stated, “That said, the judge’s decision does throw employers a bone. The court reasoned that, even if the separation agreement specifically prohibited the filling of an EEOC complaint, this portion of the agreement merely would be unenforceable. However, it would not constitute a pattern or practice of resistance to federal discrimination laws, which EEOC, in effect, was arguing here.”
