In a Sunday edition of the Chicago Tribune, Franczek Radelet partner Jeff Nowak was quoted extensively on the impact that the Supreme Court's decision in Wal-Mart Stores, Inc. v. Dukes would have on employers. Jeff was featured in a new column in the Tribune entitled, "Business Voices - Outside Opinion: Wal-Mart sex-bias ruling implications debated." The article included two viewpoints on the decision, one from the employer perspective provided by Jeff and one from the employee perspective provided by a Northwestern University professor.
"Clearly this decision is a win for employers, but it's no magic bullet for employers," commented Jeff. "I do see this changing the way employers do business." Noting that the Wal-Mart decision now ensures that class action standards will be rigorously applied in employment discrimination lawsuits to ensure a commonality among all members of a proposed class, Jeff predicted that the Wal-Mart decision actually may cause an increase in class actions that are more limited in scope.
On a more practical level, Jeff offers several recommendations to employers to minimize their exposure to class action lawsuits. See the article and Jeff's recommendations here.
