Preparing for a Potential DOL Complaint

Bill Pokorny was quoted in What’s Working in Human Resources on how to prepare for a potential Department of Labor (DOL) complaint.  A posting from the FMLA Insights blog is featured in the question-answer section.  Bill provides a list of documents to have ready to respond to DOL requests, which include:

  • Copies of all relevant policies, including FMLA, attendance, vacation and sick leave policies
  • Copies of all notices provided to the worker regarding FMLA leave and all correspondence, certifications and documents relating to FMLA leave up to the last three years
  • Worker's time, payroll and attendance records for the three preceding years, including a record of all FMLA leave used by the worker
