Although the ADA Amendments Act did not change the definition of "disability," the Act and its final regulations significantly broaden how this term is construed, so as to expand the number of individuals considered to be disabled, notes Jeff Nowak, a labor and employment attorney at Franczek Radelet in Chicago. As the column points out, the new regulations issued last month by the U.S. Equal Employment Opportunity Commission were mandated by the ADA Amendments Act of 2008 and will take effect on May 24.
