Jeff Nowak was quoted extensively in the article "Know Your Rights Under Family and Medical Leave Act" published by Hospitality Law on January 1, 2011.  In the article, Jeff further discusses FMLA abuse and provides an approach for handling leave requests.

" By its very nature, intermittent leave lends itself to abuse.  As attorneys, we're increasingly finding doctors who give their patients carte blanche to take leave as they see fit.  But as employers, we're required to grant intermittent leave only when such leave is medically necessary and the necessity of that leave is best accomodated through intermittent leave or a reduced schedule leave."

"It's a common misconception that employers can't inquire about an employee's need for leave.  The new regulations from 2009 give employers an excellent opportunity to obtain information from an employee up front so you can determine if FMLA is triggered."
