Darcy Kriha was quoted in the article "The Top 10 Legal Issues" published by the American School Board Journal in October 2010. Darcy, a member of the Council of School Attorneys (COSA), responded to a survey conducted this summer identifying the top 10 legal issues in K-12 education. In this article, Darcy discusses the issue of special education and a worrisome trend related to Individuals with Disabilities Education Act's (IDEA) provisions for planning the transition of students with disabilities to adult life.

"The duties of the K-12 system in relation to serving special education-eligible students are slowly expanding into postsecondary territory. School districts are not universally prepared to serve special education-eligible students ages 18 to 21. This is an area of increasing litigation."

Darcy further discusses the issue of medically fragile students and is quoted "[medically fragile students] are a growing area of litigation, particularly as [these] students transition between attendance centers and reach the age of majority."
