Jeff Nowak Quoted in Inside Business Article on FMLA Abuse

Jeff Nowak was quoted extensively in the article, “How to stay in step with FMLA,” published by Inside Business on October 11.  In the article, Jeff discusses a FMLA related matter he handled for client where an employee was certified for intermittent leave due to migraine headaches, and the employer suspected FMLA abuse. 

"I get calls on a daily basis about the medical certification form," Nowak said about employer questions. "They are uncertain about what the doctor stated in the form, the general ambiguity and inconsistency of what the employee said, and what's actually on the form.

"A medical certification is not complete when one or more of the sections are simply not filled out by the health care provider," he said. "What we commonly run into is a situation where a medical certification is insufficient. That means all the sections are completed by a doctor but are inadequate for understanding the employee's serious health condition, the duration of the condition, when they need leave and when they might return to work.

"This time is critical for an employer to push back and make the employee go back to the health care provider and obtain a sufficient medical certification," he said.
