Appeals Court Holds NCLB Creates No Individual Cause of Action

Parents in Newark, New Jersey, sued the Newark Public Schools claiming that the school district violated the parental-notice and supplemental education services provisions of the No Child Left Behind Act. The Court rejected the suit, holding that only the Secretary of Education has authority under NCLB to enforce those provisions. A link to the opinion is included.
