Department of Labor Issues Final FMLA Rules

On November 17, 2008, the U.S. Department of Labor ("DOL") published final rules substantially amending the existing regulations under the Family and Medical Leave Act ("FMLA"). These rules are the first changes to the exiting FMLA regulations since they went into effect in 1995. The new rules take effect on January 16, 2009. Until then, employers should continue following the existing FMLA regulations.
