Roberts Court to Hear Oral Arguments in First Employment Discrimination Case

This Wednesday, April 22, 2009, the Supreme Court is scheduled to hear oral arguments in Ricci v. DeStafano, a case that brings before the Court issues of equal employment. Front & Center previously reported on Ricci in a posting found here.
The Ricci case involves the Connecticut City of New Haven’s decision to deauthorize a number of offered firefighter promotions after the results of a qualification exam administered by the City revealed that of 15 available positions, 14 would go to White firefighters and none would go to African-Americans. The firefighters affected by the decision to deauthorize the positions filed suit and allege that the City discriminated against them based on their race in violation of Title VII and the Equal Protection Clause of the U.S. Constitution.
